Terms of Use

These terms apply to The Phangan Quest, a story game played on your phone, and to this website, phanganquest.com. They are the licence terms for the game. Please read them before you buy. We wrote them in plain English, so you can understand them on a phone, in the sun, on one bar of battery.

1. Who is who

MAD Global LLC makes, publishes and supports The Phangan Quest. We are a limited liability company registered in Wyoming, USA. Our registered address (through our registered agent) is 30 N Gould St, Sheridan, WY 82801, USA. In these terms, “we”, “us” and “our” mean MAD Global LLC.

Our order process is conducted by our online reseller Fungies. Fungies is the Merchant of Record for all our orders: it sells the game licence to you, takes your payment and handles payment questions, receipts and refunds. Support for the game itself comes from us, at support@phanganquest.com.

In practice, Fungies runs the checkout, takes your payment, calculates and pays any sales tax or VAT, sends your receipt, issues any invoice, and handles refunds and payment disputes. The Fungies company that sells to you, Fungies Inc. (USA) or Fungies Europe PSA (Poland), is named at checkout and on your receipt.

Two agreements apply. Fungies’ Buyer Terms govern the purchase, between you and Fungies. These Terms of Use govern your licence to play the game, between you and us. They are the seller terms that Fungies’ Buyer Terms refer to. You accept both when you buy.

Who to contact for what

• The game, your start code, Telegram, anything that went wrong while playing, or a place you want reviewed: support@phanganquest.com. Questions about the game itself come to us.
• Payment, receipt, invoice, tax, a charge on your card or a refund payment: Fungies, at support@fungies.io or through the support link in your Fungies receipt. You can also write to us, and we will sort it out with Fungies for you.

We reply by email, usually within 2 business days. There is no live support while you play, and the game never needs a reply from us to continue. We are not an emergency service: see section 6.6.

2. What you are buying

You buy one licence to play The Phangan Quest, for one crew. A crew is you and the people who play one game together with you. In these terms we call this your crew licence. On our website it is also called your “team ticket” or your “crew quest”. Whatever it is called, it is a licence to play a digital game, for one crew. It is not a ticket or admission to any place or event, not a booking and not a transport ticket.

• It lets your crew play the game through once, for private, non-commercial use.
• It is a one-time payment. There is no subscription and nothing renews.
• The price is shown on our website and in Fungies’ checkout before you pay: USD 39 per crew, including any sales tax or VAT. Your bank may add its own fee for paying in a foreign currency.

After payment, your start code is shown on the confirmation page and emailed to you. Send it to The Phangan Quest game chat on Telegram, and the story begins. The game comes as text, voice messages and images, in English.

The buyer must be 18 or older and legally able to make this contract where they live. Before you start, show the safety notes in section 6 to everyone in your crew.

3. What you need to play

• A smartphone with the Telegram app and a Telegram account. Telegram is free and is provided by a separate company, under its own terms.
• Mobile data, at your own cost, and a charged phone. Coverage is weak in parts of the island.
• Paper and a pen for each player.
• Cash for two small entrance fees (see section 4) and for food along the way.

Nothing is sold inside Telegram. The crew licence is bought only on phanganquest.com.

4. What is not part of the product

You buy a game on your phone, and nothing else. The game is text, audio and images sent to your phone, and that digital game is the whole of what we supply. We do not provide or arrange:

• transport or vehicles;
• a guide, host or meeting point, or anyone who meets, accompanies or supervises you;
• admission to any place, bookings or reservations;
• meals, drinks, accommodation or equipment;
• travel, accident or medical insurance.

Nobody from MAD Global LLC is at any of the places in the game, and nobody from us can see what is happening where you are. We have no office or service point on Koh Phangan. We place nothing at any location.

Places in the game are run by other people. They set their own opening hours, rules and fees. At the time of writing, two places charge an entrance fee or expected donation of about 50 THB and 40 THB per person, which you pay directly to the place. Other temple donations are voluntary. The places are independent of us: we do not run them, and they do not run the game.

5. How the game works: you decide, you can skip

The game is written around real, public places on Koh Phangan, Thailand: roads, viewpoints, beaches and temples. You do not have to go to any of them. The whole story reaches you whether or not you go anywhere.

• You can skip any task: tap Skip, or write “skip”. Skipping never stops the story.
• There is no timer, no score, no ranking and no prize.
• The game never needs a reply from us to continue.
• The game never asks for or checks your location.
• You decide when to start, pause, continue and stop. The game remembers where you stopped.

We store your progress and your replies so the game can continue where you left off. Our Privacy Notice explains what we keep and for how long.

6. Real places, real conditions

This section matters more than anything else on this page. Read it before you set out.

6.1 The conditions

Getting to the places in the game means riding on public roads, some of them steep, winding or wet. It means walking on uneven paths, wet rock and staircases, in tropical sun and heat. Some months bring sudden heavy rain. One stop is a roadside where wild monkeys live. These conditions exist whether or not you play, and they change from day to day. Nobody from us is there, so only you can see them. You decide whether to go anywhere, how you travel, and whether to do, skip or stop any part of the day. You decide for anyone in your care.

6.2 Riding

• Never read, listen to or answer the game while riding or driving. Our travel messages end with “Put your phone away now”, and the next chapter opens only when you tell the game you have arrived and parked.
• Park fully off the road before you use your phone.
• To ride a motorbike in Thailand you need a licence that covers motorcycles and is valid in Thailand. Thai law requires a helmet for the rider and every passenger, children included.
• Never ride after drinking alcohol.
• Map links open Google Maps, a separate service. We do not choose or check its routes. Choose roads you can ride safely.
• Many travel insurance policies do not pay out if you ride without a valid licence or a helmet. We strongly recommend insurance that covers what you actually do.
• It gets dark early and fast in Thailand, all year. We recommend riding in daylight. If you stay for the sunset at the last stop, you will ride back in the dark: go slowly, or finish another day.
• Check the weather before you set out. If it turns, stop and continue another day.

6.3 Stairs, heat and health

No task asks you to swim or go into the water, climb rocks, trees, walls or statues, go past a gate, fence or sign, stand near an edge, step into a road, enter private land or drink alcohol. No task needs speed. Three stops involve staircases, and some of them are long and steep. Take them slowly, hold the rail where there is one, and rest in the shade. Skip them if you are pregnant, if you have a heart, breathing, joint or balance condition, or if you are unsure of your fitness. Nothing in the story depends on them. Bring water, sun protection and insect repellent.

6.4 The shore and wild animals

Some stops are at the shore. No task asks you to go into the sea. If you choose to swim, that is your own decision, outside the game. We cannot know the sea conditions on the day, and there may be no lifeguard. At the monkey stop, stay by your parked scooter, fully off the road and at least 7 metres from the monkeys, with bags closed and hands empty. Never feed or touch any animal. Monkeys can bite or scratch. If that happens, wash the wound with soap and water and get medical help the same day. No drones.

6.5 Children

The game is sold to adults. Children play only together with a parent, guardian or other responsible adult who stays with them the whole time. That adult decides for them whether a place, a staircase, the shore, a task or a ride is suitable, including whether a child rides as a passenger. The game is designed for children aged 7 and up.

6.6 Local rules and emergencies

Local rules and staff instructions always come first. If a sign, a staff member, a monk or an official says something different from the game, follow them and skip the task. We are not an emergency service, and we cannot send help. In an emergency, never wait for us. In Thailand, call 1669 (medical emergency), 1155 (tourist police, English-speaking) or 191 (police).

7. Respect for places and people

Temples are active places of worship. Cover shoulders and knees, take your shoes off where others do, keep your voice down, and never touch or climb on statues, shrines or sacred objects. Do not photograph people, especially monks and children, without their permission. Take nothing and leave nothing: not a stone, not a shell, and never coral.

8. Photos

Some tasks invite you to send a photo of a place, an object, or animals seen from where you stand. Sending a photo is always optional. Some moments invite you to take a photo of your own crew for yourselves: you keep those and do not send them. There are no photo tasks at temples.

Please never send a photo in which a person can be recognised, especially a child, or anything unlawful. We do not download or keep the photos you send. They stay in your Telegram chat, where you can delete them. We will never publish a photo of yours without first asking you and getting your clear permission.

9. Places change

This version of the game describes places, stories, counts, fees, opening times and directions as they were when it was written. Places change. A path can close, a fee can change, stairs can be wet or under repair, a building can be fenced off, a tree can fall.

Nobody from us checks the places on the day you play, and we cannot know their condition. Treat what the game says as a description, not a promise that a place is open, reachable or safe. If what you see is different, trust what you see and skip the task. Then tell us at support@phanganquest.com. We review every report, and we may change or switch off a stop at any time.

The history and legends in the game are retold for entertainment. Any fortune or prophecy in the story is part of the game: it is there for fun, and it is not a prediction or advice.

If you are responsible for a place in the game and want it changed or removed, write to support@phanganquest.com. We will review it and act promptly.

10. Your crew licence: sharing, misuse and suspension

Your crew licence is for your crew only. You may not:

• resell, auction, rent, publish or share your start code outside your crew;
• use the game to run a paid or organised group activity, or any commercial offering of your own;
• copy, record or republish the game’s text, audio or images;
• send the game anything unlawful, sexual or abusive.

Your start code cannot be exchanged for cash, apart from the refunds in sections 11 and 12.

If we see clear evidence of a breach, we will email you, tell you what we saw, and give you 5 days to reply before we suspend the licence. If you sent something unlawful, we may suspend it at once. If we got it wrong, we restore your licence or have Fungies refund you, whichever you choose.

If a payment is disputed, your licence may be paused while the dispute is open. It ends if the payment is reversed.

If you use the game commercially in breach of this section, you are responsible for the reasonable costs and losses your breach causes us.

11. 14-day money-back guarantee

If you ask within 14 days after the day you bought, you get a full refund. No reason is needed, and there are no conditions. It does not matter whether you have started or finished the game.

• Email support@phanganquest.com, or request a refund from Fungies at support@fungies.io or through the support link in your Fungies receipt.
• Please include your order number or the email address you used, so we can find your order.
• We do not pay refunds ourselves. We ask Fungies to refund you, and Fungies pays the full amount back to your original payment method.
• Once the refund is approved, your start code stops working.

Fungies’ Buyer Terms, including their refund rules, also apply. Where the two differ, you get whichever is better for you. Full details are in our Refund Policy. Please contact us or Fungies before disputing a charge with your bank: a refund is faster.

12. If something is wrong with the game

The game should match how it is described here and on our website, and it should work. If it does not, write to support@phanganquest.com and tell us what happened.

If a fault on our side stops you playing and we cannot fix it within 2 business days, you choose: we extend your licence, or we have Fungies refund you in full. This is not limited to the first 14 days.

You also keep your legal rights if the game is faulty or not as described. These terms do not reduce them.

13. Our responsibility

13.1 What we never exclude

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to exclude or limit. Your legal rights if the game is faulty or not as described are not affected.

13.2 What we are responsible for

We are responsible for the game: that it is as described, that it works, and that it is written with reasonable care. If we break these terms or are negligent, we are responsible for loss that was a foreseeable result.

13.3 What we are not responsible for

We are not responsible for loss or harm we did not cause. For example, we are not responsible for harm caused by:

• traffic, road or sea conditions, weather or animals;
• the condition, rules, staff or fees of any place;
• any vehicle you ride or rent, or other people;
• Telegram, Google Maps, mobile networks or your phone.

13.4 Your choices

You are responsible for your own choices and conduct on the day, for following Thai law and local rules, and for anyone in your care.

13.5 Limit

Subject to 13.1, our total liability to you for all claims connected with the game is limited to the price you paid for it.

13.6 Business losses

The game is for private use. We are not liable for lost profit, lost business or other business losses.

13.7 Our people

Sections 13.3 to 13.6 also protect our owner, managers, employees and contractors, and the people who wrote and produced the game, who may rely on them.

14. No other promises

Apart from these terms and the rights the law gives you, we make no other promises about the game. For example, we do not promise that every place will be open, that the weather will cooperate, or that every task will suit every crew. If you are a consumer, your legal rights stay in full.

15. There is nothing to win

There are no prizes, prize draws, cash, rewards or rankings of any kind. The reward is the day itself.

16. The game and the website

The Phangan Quest belongs to MAD Global LLC, including its story, text, audio, images, design and code, and so does this website. Your crew licence lets your crew play the game once. It does not transfer any ownership.

Honest reviews and your own photos of your day are always welcome. We only ask you not to post the riddles, the answers or the route. This never limits your right to post an honest review.

Real place names, brands and third-party materials mentioned in the game belong to their owners.

17. Complaints

If something has gone wrong, write to support@phanganquest.com. Tell us what happened, what you expected, and your order number or order email. We aim to reply within 2 business days, and we will tell you what we can do. For a payment or a refund payment, you can also contact Fungies at support@fungies.io.

18. Changes to these terms

We may update these terms as the game develops. Every version is numbered and dated.

The version in force on the day you bought applies to your purchase. A later change does not take away anything you bought. We keep a record of which version applied to each order.

19. Law, courts and your consumer rights

These terms are governed by the laws of the State of Wyoming, USA. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in its courts.

Before starting a claim, please write to us first so we can try to put it right. This does not affect any legal time limit. We do not require arbitration. Fungies’ Buyer Terms, including their own law and dispute rules, apply to the purchase.

20. General

If a court finds any part of these terms unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. We may transfer these terms to another company that takes over the game; your rights under them stay the same. You may not transfer your licence outside your crew.
